Child Support
In New Mexico, child support is calculated based on a formula provided by the state. The formula includes the incomes of both parents, factors in the need for health insurance, day care and other special needs of the child, and can be adjusted based on the amount of time spent with the child. We will review all proposed child support orders for you, ensuring compliance with the New Mexico guidelines. We will also verify that all relevant sources of income, including self-employment income, seasonal income and commission-based income, are fairly considered in the calculation.
Paternity Actions
In New Mexico, a determination of paternity can lead to an order for up to 12 years of back child support. If you are alleged to be the father of a minor child, we can help protect your rights, making certain that you don't make any statements or acknowledgements of paternity, that all procedures are properly followed, and that testing is correctly conducted. If the tests show that you are the father, we will work with you to help you get visitation and custody rights, if appropriate, and to come to a fair resolution on back child support.
